Acceptance of Terms
By creating an account or using the HaulDesk AI platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of a company or other legal entity, you represent that you have authority to bind that entity, and "you" refers to that entity.
If you do not agree to these Terms, do not use the Service. These Terms apply in addition to our Privacy Policy, which is incorporated by reference.
The Service
HaulDesk AI provides an AI-powered phone answering platform built specifically for trucking companies and freight operators. The core service includes:
- AI answering of inbound calls to your configured phone number, 24/7
- Real-time speech-to-text transcription of call audio via Deepgram
- AI response generation via Anthropic Claude, customised to your business
- Automated collection of freight booking details over the phone
- Caller self-service shipment tracking lookups using your data
- Instant call escalation to a human agent when required
- Email notifications for new bookings and escalated calls
- A web dashboard for call logs, transcripts, bookings, and shipments
We reserve the right to modify, suspend, or discontinue any feature of the Service with reasonable notice. We will not materially reduce core functionality during an active paid subscription without offering a pro-rated refund for the unused period.
Eligibility & Account
You must be at least 18 years old and operating a legitimate business to use HaulDesk AI. The Service is designed for commercial freight, trucking, and logistics operations — not personal or consumer use.
Account Security
You are responsible for maintaining the confidentiality of your login credentials. Do not share your password. You are responsible for all activity that occurs under your account. Notify us immediately at navjotsumandev@gmail.com if you suspect unauthorised access.
One Account per Business
Each HaulDesk AI account is tied to one business entity. You may not create multiple accounts to circumvent plan limits or trial restrictions.
Your Responsibilities
Required
As an Account Holder, you agree to:
- Disclose to your callers that calls are answered by an AI assistant and may be transcribed — through your greeting script, website notice, IVR disclosure, or other legally sufficient means
- Obtain all necessary consents required by applicable law before routing calls through HaulDesk AI (including two-party consent states: CA, IL, FL, WA, PA, etc.)
- Provide accurate company information, greeting scripts, and AI configuration that does not mislead callers
- Keep your payment method current to avoid service interruption
- Not use the Service to handle emergency calls (911, medical emergencies, suicide hotlines, etc.)
- Review AI-generated bookings and transcripts for accuracy — you remain responsible for fulfilling any commitments made during calls
- Promptly notify us of any legal claims or regulatory inquiries relating to your use of the Service
AI Limitations & Disclaimer
Important
You acknowledge and agree that:
- The AI may misunderstand callers, mishear spoken words, or give incorrect information — especially for ambiguous, complex, or unusual queries
- Speech-to-text transcription may contain errors, particularly for heavy accents, noisy environments, or industry-specific terminology
- The AI may collect incomplete or inaccurate booking details — you must verify all AI-captured bookings before acting on them
- The AI cannot replace human judgment for complex negotiations, pricing decisions, legal questions, or safety-critical situations
- HaulDesk AI is not liable for missed loads, lost revenue, or business harm caused by AI errors, transcription inaccuracies, or call mishandling
- The AI will identify itself as an AI to callers — it will not impersonate a human when directly asked
The Service is provided as a tool to assist your business operations, not as a guarantee of any particular call outcome. You retain full responsibility for your customer relationships and business decisions.
Acceptable Use
You agree not to use HaulDesk AI for:
- Any unlawful purpose or in violation of any applicable local, state, federal, or international law
- Handling emergency calls or calls where caller safety is at risk
- Deceptive practices — e.g. claiming your AI is a human when sincerely asked
- Collecting sensitive personal data beyond what is needed for freight operations (SSNs, financial account numbers, health information, etc.)
- Harassing, abusing, or discriminating against callers
- Attempting to reverse-engineer, scrape, or exploit the Service infrastructure
- Reselling or white-labelling the Service without our written permission
- Any purpose that competes directly with HaulDesk AI's core business
Violation of this section may result in immediate account suspension without refund.
Billing & Subscriptions
Plans & Pricing
HaulDesk AI offers monthly subscription plans billed in advance. Current pricing is listed at hauldeskai.com/#pricing. Prices may change; we will provide 30 days' notice before any price increase takes effect for existing subscribers.
Founding Customer Pricing
Customers who subscribe during the founding period lock in their price permanently for as long as they maintain an active, uninterrupted subscription. If you cancel and resubscribe, the founding rate no longer applies.
Free Trial
New accounts receive a 7-day free trial with a capped minute allowance. No credit card is required to start the trial. At trial end, service pauses until a paid plan is selected. Trial usage data (call logs, bookings) is retained for 7 days after trial expiry.
Minute Usage
Each plan includes a monthly minute allowance for AI-handled call time. Minutes reset on your billing anniversary. Unused minutes do not roll over. When your minute limit is reached, incoming calls receive a polite "service unavailable" message until the next billing cycle or you purchase a top-up block.
Refunds
Subscription fees are non-refundable except where required by law. If you believe you were charged in error, contact us within 30 days of the charge and we will investigate. If we confirm the error, we will issue a credit to your account or a refund to your original payment method.
Failed Payments
If a payment fails, we will retry up to 3 times over 7 days. After 3 failures, your account is placed on hold — calls will not be answered until payment is resolved. We will email you at each stage. Account data is retained for 30 days on hold before deletion.
Termination
By You
You may cancel your subscription at any time from your dashboard under Settings → Billing. Cancellation takes effect at the end of the current billing period — you retain access until then. After cancellation, your data is retained for 30 days during which you can export transcripts and bookings, then permanently deleted.
By Us
We may suspend or terminate your account immediately for: (a) material breach of these Terms; (b) non-payment; (c) fraudulent or illegal use of the Service; (d) activity that threatens the security or integrity of our platform. We will attempt to notify you by email prior to suspension except where immediate action is required to protect users or the platform.
Effect of Termination
On termination, your right to use the Service ceases immediately. Sections 5, 9, 10, and 11 of these Terms survive termination.
Limitation of Liability
To the maximum extent permitted by applicable law:
- THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE OR UNINTERRUPTED AVAILABILITY
- HAULDESK AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, OR MISSED FREIGHT OPPORTUNITIES
- OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 3 MONTHS PRECEDING THE CLAIM
Some jurisdictions do not allow limitation of certain warranties or liabilities. In those jurisdictions, our liability is limited to the fullest extent permitted by law.
Intellectual Property
Our IP
HaulDesk AI and all its components — software, design, AI prompts, training data, branding, and documentation — are owned by HaulDesk AI and protected by copyright, trademark, and other intellectual property laws. You receive a limited, non-exclusive, non-transferable licence to use the Service for your internal business purposes.
Your Data
You retain full ownership of your data: your company information, call transcripts, booking records, and shipment data. You grant us a limited licence to process this data solely to deliver the Service to you. We will never use your proprietary business data to train AI models or for any purpose beyond providing the Service.
Feedback
If you provide feedback or suggestions about the Service, you grant us the right to use that feedback without restriction or compensation.
Disputes & Governing Law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the Service shall be resolved first through good-faith negotiation. If negotiation fails within 30 days, disputes shall be resolved by binding arbitration under the JAMS Streamlined Arbitration Rules, conducted in English. The arbitrator's decision is final and binding.
You waive the right to participate in class action lawsuits or class-wide arbitration. Claims must be brought individually.
Nothing in this section prevents either party from seeking emergency injunctive relief in a court of competent jurisdiction to prevent irreparable harm.
